This morning, in the Western Cape High Court, the case of Jeremy Acton of The Dagga Party of South Africa, Ras Gareth Prince (and all the other cases that have been granted stay in prosecution pending the outcome their case) was postponed until next year.
Judge Dennis Davis stated that the representations presented by the plaintiffs contained only articles, no evidence in the form of expert witnesses or affidavits. He believes that the issue of Cannabis legalisation in South Africa is such an important one that it requires a lengthy enquiry that is supported by extensive and irrefutable evidence.
The judge was affable, positive and very supportive of the plaintiffs. He is giving them time to get their evidence and witnesses in order so that they can have the best chance of success. He has pledged to help Jeremy and Gareth wherever he can. Here is the first media article on this morning’s proceedings.
The lack of credible evidence has always concerned us around the Western Cape cases and it could have been that the judge allowed the plaintiffs to continue and, ultimately, fail in their quest. He didn’t do this and for this we, the South African Cannabis community, are grateful. We salute Jeremy and Gareth for all the work they have done so far. Now everyone can see for themselves why it is so important for us to raise the money to present a world class Trial of the Plant with as many experts as we can afford.

Hi Louise, here’s the link to the latest news. Unfortunately we have to wait until next year to start proceedings in the Pretoria High Court but details are in the article. Please note that The Dagga Couple’s case is different to Jeremy Acton’s case in the Western Cape High Court in Cape Town.
