There have been a number of cases of the South African Police Service wanting to pursue citizens who were granted stays in prosecution pending the outcome of The Dagga Couple case.
One such case managed to get the outcome in writing from the Director of Public Prosecutions in the Western Cape. All other cases that have come to our attention have been successful in upholding their stays but it has proved impossible to get the decision of the court in writing up until now.
When the “Privacy Judgement” was handed down last year, Fields of Green for ALL took the decision not to continue to offer help in obtaining stays in prosecution as The Dagga Couple case has been postponed until after the government has tabled new laws and regulations in the legislature. We still offer citizens information on how to deal with a Dagga arrest but…
As we have said before, we will only continue with The Trial of the Plant if our government does not give us a laws and regulations that are constitutionally sound, based on scientific evidence in line with our human right to cognitive liberty and in proportion to the existing laws for more harmful substances such as tobacco and alcohol.
We want the South African Police Services removed from having anything to do with Dagga, immediate and unconditional release of all Dagga prisoners and reparations for the harms of prohibition.
Tick all of these boxes and we are good to go BUT we are waiting in the wings if you don’t.
Therefor… All stays of prosecution – ALL 104 of them, granted in 7 of the 9 High Courts in South Africa – stay in place until the very end – until The Dagga Couple walk out of the Krugersdorp Magistrate’s Court with their bail money in their hands.
If you have a stay in prosecution and you have any questions (we think we have managed to contact most people on the list) please contact us. It is not that simple to overturn a High Court judgement and that is what a stay in prosecution is.
