16 May 2011: Our Founding Affidavit  is handed in at the Pretoria High Court on the same day as we appear in the Magistrate’s Court for the 2nd time. The Magistrate in Krugersdorp gives us leave to appeal to the Pretoria High Court for a hearing on the Constitutionality of the matter.19 July 2011. The Honorable Mr Justice Bertelsman grants us a Stay in Prosecution, pending the outcome of our Constitutional challenge. We have 60 days to institute proceedings to challenge the Constitutionality of sections 4(b), 5(b) and Part III of Schedule 2 of the Drugs & Drug Trafficking Act, 1992, as it pertains to Dagga.Our story appears in the Pretoria News and we become “The Dagga Couple”.August 2011: Charges of possession and dealing have been struck off the roll at the Magistrate’s Court, pending the outcome of the constitutional challenge. Our case is officially out of the Magistrate’s Court and in the High Court. Charges are not withdrawn. They will come back if we fail in our quest to change the law.September 2011: We serve summons on 7 South African government departments, charging them with enacting unlawful laws and ordering that they reply within 20 days with their intention to defend these claims or not.
